These Terms of Service constitute a legally binding agreement between you (“User”) and MHQ Exchange Ltd (“MHQ Exchange,” “we,” or “our”). By accessing or using our platform, services, or any related features, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. Your continued use of the platform constitutes acceptance of any updates or modifications to these Terms that might occur in the future, within our guidelines.
2. Eligibility Requirements
You must be at least 18 years of age and capable of entering into legally binding agreements under applicable law. By using MHQ Exchange, you represent and warrant that you meet all eligibility requirements and will comply with all applicable laws and regulations.
3. Account Security
- Maintain the confidentiality of your login credentials
- Enable two-factor authentication (2FA)
- Immediately report any unauthorized access
- MHQ Exchange is not liable for losses due to compromised accounts
To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to notify MHQ Exchange immediately of any unauthorized use or security breach.
4. Prohibited Activities
You agree not to engage in any activity that may harm the platform or other users, including but not limited to:
- Market manipulation or wash trading
- Use of unauthorized bots or scripts
- Engaging in fraudulent transactions
- Attempting to interfere with platform operations
Users of MHQ Exchange are strictly prohibited from engaging in any activities that may compromise the integrity, security, or legality of the platform. Prohibited activities include also:
- Illegal Activities: Using the platform for any unlawful purposes or in violation of applicable laws and regulations.
- Fraudulent or Deceptive Practices: Engaging in fraud, impersonation, or manipulation, including false representation of identity or trading activity.
- Market Manipulation: Attempting to manipulate prices, trades, or the trading environment in any manner.
- Unauthorized Access: Accessing or attempting to access accounts, systems, or data without proper authorization.
- Spamming or Malicious Activities: Distributing spam, malware, viruses, or any harmful code through the platform.
- Circumventing Controls: Bypassing security measures, usage restrictions, or regulatory compliance mechanisms implemented by MHQ Exchange.
- Disruption of Services: Interfering with the proper functioning of the platform, including overloading systems or disrupting network traffic.
5. Fees and Payments
MHQ Exchange reserves the right to modify fees with prior notice of at least 14 days.
6. Risk Disclosure
Cryptocurrency trading involves substantial risk. Prices can fluctuate dramatically. You may lose your entire investment. Only trade with funds you can afford to lose. By using the platform, users acknowledge and agree to the following:
- Market Volatility: Cryptocurrency markets are highly volatile. Prices can fluctuate rapidly, and past performance is not indicative of future results. Users may experience substantial gains or losses.
- Financial Risk: Trading and investing in digital assets may result in partial or total loss of funds. Users should only trade with capital they can afford to lose.
- No Guarantees: MHQ Exchange does not provide investment advice, guarantees, or warranties regarding profits, returns, or market outcomes. Users are solely responsible for their trading decisions.
- Regulatory Risk: Cryptocurrency trading may be subject to changing regulations in your jurisdiction. Users are responsible for understanding and complying with all applicable laws.
- Platform Risk: While MHQ Exchange implements robust security measures, the platform cannot guarantee absolute protection against technical failures, cyber-attacks, or unauthorized access.
7. Limitation of Liability
To the fullest extent permitted by law, MHQ Exchange Ltd (“MHQ Exchange”) and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the platform, including but not limited to:
- Trading Losses: Any losses or damages incurred as a result of trading cryptocurrencies or digital assets on the platform.
- Platform Downtime or Errors: Losses caused by system failures, technical errors, or unavailability of the MHQ Exchange platform.
- Unauthorized Access: Any damages resulting from unauthorized access to your account or platform security breaches, except where such damages result from MHQ Exchange’s gross negligence or willful misconduct.
- Third-Party Services: Any damages resulting from the use of third-party payment providers, liquidity providers, or other external services integrated with the platform.
8. Governing Law
These Terms of Service, and any disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Australia. By using MHQ Exchange, users agree that any legal action, claim, or dispute arising from or relating to the platform, these Terms, or their use of the services shall be subject to the exclusive jurisdiction of the courts of Australia. Nothing in this section shall limit MHQ Exchange’s right to seek injunctive or equitable relief in any jurisdiction to protect its intellectual property, assets, or rights.
